AI Compliance Checklist 2026: 7 Steps Every Business Needs

A practical AI compliance checklist for 2026—covering inventory, risk classification, impact assessments, governance, bias audits, documentation, and ongoing monitoring. Includes Colorado, EU AI Act, and ISO 42001 requirements.

Why AI Compliance Is Urgent in 2026

Two deadlines have turned AI compliance from a future concern into an immediate operational priority.

Colorado SB 24-205 (as amended by SB 26-189) takes effect January 1, 2027. Colorado's AI Act is the first comprehensive state-level AI law in the United States. It imposes obligations on developers and deployers of high-risk AI systems—defined as systems that make or substantially assist consequential decisions in employment, credit, education, housing, insurance, and healthcare. Companies that miss the January 1, 2027 deadline face enforcement by the Colorado Attorney General.

The EU AI Act is phasing in through 2026 and 2027. Prohibited AI practices were banned as of February 2025. High-risk AI system requirements under Article 6 and Annex III apply from August 2026. Companies selling into or operating in the EU market must have compliance programs in place before those dates.

Against this backdrop, every organization using AI in consequential decisions needs a working AI compliance checklist—not a theoretical framework, but an operational roadmap with clear owners and completion criteria.

This is that checklist.


The 7-Step AI Compliance Checklist

Step 1: Inventory Every AI System You Use or Deploy

You cannot comply with regulations you have not mapped. The first item on any AI compliance checklist is a complete, current inventory of all AI systems in scope.

What to document for each AI system:

  • [ ] System name, vendor (if third-party), and version
  • [ ] Business function and use case (e.g., resume screening, loan underwriting, fraud detection)
  • [ ] Whether the system is developed internally or procured from a vendor
  • [ ] Which departments and geographic markets use the system
  • [ ] What data the system processes (especially personal data and sensitive categories)
  • [ ] Whether the system makes or informs consequential decisions
  • [ ] Name of the business owner accountable for the system

Why this matters for specific regulations:

  • Colorado AI Act requires deployers to maintain records of high-risk AI systems and provide documentation to the AG upon request.
  • EU AI Act requires a conformity assessment for high-risk AI systems before market placement—you cannot assess conformity without knowing what systems you have.
  • ISO 42001 requires a defined AIMS scope, which begins with an AI system inventory.

Common gap: AI systems embedded in enterprise SaaS tools (Workday's skills matching, Salesforce's lead scoring, ServiceNow's predictive routing) are frequently omitted from inventories. If a vendor's AI informs your decisions, it belongs in your inventory.


Step 2: Classify Each System by Risk Level

Once you have an inventory, classify each system by the risk framework applicable to your jurisdiction.

  • [ ] Apply the EU AI Act risk ladder: prohibited, high-risk (Annex III), limited-risk, minimal risk
  • [ ] Apply the Colorado AI Act definition: does the system make or substantially assist a consequential decision affecting a Colorado resident?
  • [ ] Flag systems that process sensitive personal data (race, health, biometrics, financial data) as elevated risk regardless of regulatory classification
  • [ ] Document your classification rationale for each system—auditors will ask why a system was or was not classified as high-risk

EU AI Act Annex III high-risk categories include:

  • Biometric identification and categorization
  • Critical infrastructure management
  • Education and vocational training access
  • Employment and worker management (hiring, task allocation, performance monitoring)
  • Essential private and public services (credit, insurance)
  • Law enforcement
  • Migration, asylum, border control
  • Administration of justice

Colorado AI Act consequential decisions include: education enrollment, employment, financial services, healthcare, housing, insurance, and legal services affecting Colorado residents.

  • [ ] Assign each system a risk tier (Prohibited / High-Risk / Limited-Risk / Minimal-Risk) and document the basis

Step 3: Conduct AI Impact Assessments for High-Risk Systems

For every system classified as high-risk, conduct a documented AI impact assessment before deployment and before significant changes.

  • [ ] Document the AI system's intended purpose, intended users, and reasonably foreseeable uses and misuses
  • [ ] Identify the population affected, including demographic breakdowns where available
  • [ ] Assess potential harms: discrimination, financial harm, physical harm, reputational harm, loss of rights
  • [ ] Assess likelihood and severity of each identified harm
  • [ ] Identify and document risk mitigation measures
  • [ ] Document residual risks after mitigation and obtain sign-off from accountable business owner
  • [ ] Retain the completed impact assessment as a permanent compliance record

Colorado AI Act specifically requires deployers to complete an impact assessment before deployment of any high-risk AI system. The AG may request these assessments during investigations. There is no safe harbor for deployers who cannot produce one.

  • [ ] For EU high-risk AI systems, ensure the impact assessment addresses the EU AI Act's conformity assessment requirements (Article 43), including technical documentation under Annex IV

Step 4: Implement AI Governance Policies and Controls

Impact assessments identify risks. Governance policies and controls manage them on an ongoing basis.

  • [ ] Adopt a written AI governance policy approved by senior leadership that covers acceptable use, prohibited uses, risk tolerance, and accountability structure
  • [ ] Designate a responsible AI function—a named individual, committee, or team—with authority to approve, pause, or decommission AI systems
  • [ ] Implement human oversight for all high-risk AI decisions: a human must be able to review, override, and correct AI outputs before final decisions affecting individuals
  • [ ] Establish an AI incident response process: how are AI failures, bias complaints, and unexpected outputs reported, escalated, and resolved?
  • [ ] Document third-party AI vendor requirements: contracts must specify data rights, audit access, bias testing obligations, and incident notification timelines
  • [ ] Implement access controls ensuring only authorized personnel can modify AI models, training data, or decision logic

Colorado AI Act requires deployers to:

  • Implement a risk management policy and program
  • Complete impact assessments
  • Provide consumers with notice that a consequential decision was made using AI
  • Provide a mechanism for consumers to appeal AI-driven decisions
  • [ ] Verify consumer notice and appeal mechanisms are in place for all Colorado-covered deployments

Step 5: Run Bias Audits on High-Risk Systems

Bias auditing is no longer optional for organizations operating in jurisdictions with AI fairness requirements. This step belongs on every AI compliance checklist that covers high-risk systems.

  • [ ] Identify which AI systems are subject to bias audit requirements (NYC Local Law 144 for employment tools used in NYC; Colorado AI Act for high-risk systems; EU AI Act for high-risk systems)
  • [ ] Engage a qualified third-party auditor for each covered system (some jurisdictions require independence)
  • [ ] Provide the auditor with historical decision data, demographic breakdowns, and model documentation
  • [ ] Receive and review the auditor's disparate impact analysis across protected categories (sex, race/ethnicity, and intersectional categories)
  • [ ] Review the auditor's findings on proxy discrimination (whether facially neutral variables function as proxies for protected characteristics)
  • [ ] Document remediation steps taken in response to adverse findings
  • [ ] Publish bias audit summaries where required (NYC Local Law 144 requires public posting)
  • [ ] Schedule the next bias audit: annual cycles are standard; more frequent auditing is warranted when training data changes significantly

Costs: Third-party AI bias audits typically range from $15,000 to $80,000 depending on system complexity, data availability, and auditor firm. Budget accordingly for each covered system.


Step 6: Document Everything and Prepare Disclosures

Regulators do not assess compliance based on what you do—they assess it based on what you can prove you did. Documentation is the compliance record.

  • [ ] Maintain a master AI register mapping each AI system to its risk classification, impact assessment, audit history, and governance controls
  • [ ] Retain training data provenance records: where did training data come from, how was it processed, when was it last updated?
  • [ ] Document model versioning: when models are retrained or updated, retain records of what changed and why
  • [ ] Implement consumer disclosure for AI-assisted decisions: individuals must be informed when AI played a role in a decision affecting them
  • [ ] Prepare regulatory documentation packages that can be produced within 30 days of a regulatory inquiry: impact assessments, audit reports, governance policies, training records
  • [ ] For EU AI Act high-risk systems, prepare technical documentation per Annex IV and ensure it is updated when systems change materially
  • [ ] Register required systems in the EU AI Act database (mandatory for high-risk AI systems deployed by public authorities and certain private operators from August 2026)

Step 7: Establish Ongoing Monitoring and Review Cycles

AI compliance is not a project with a completion date. It is an ongoing operational function.

  • [ ] Implement production monitoring for all high-risk AI systems: track decision distribution, outcome rates, and error rates across demographic groups
  • [ ] Define alert thresholds that trigger review: if demographic outcome disparities exceed defined limits, escalate for investigation
  • [ ] Conduct annual reviews of all AI impact assessments—or trigger reviews when significant changes occur (new training data, new use cases, new geographies, regulatory changes)
  • [ ] Schedule annual bias audits for all covered systems; schedule quarterly model performance reviews for the highest-risk systems
  • [ ] Update your AI system inventory quarterly: new tools are frequently adopted without compliance review
  • [ ] Track regulatory developments: Colorado's implementing regulations, EU AI Act delegated acts, and state-level AI legislation in California, Illinois, and Texas are all in motion
  • [ ] Conduct annual internal audits of your AI governance program against your policy commitments and applicable regulatory requirements
